Information regarding cookies and similar technologies is provided in Section 9 of this Privacy Policy.
Capitalised terms used in this Privacy Policy that are not separately defined herein shall have the meanings assigned to them in the Plugin X EULA available at:

1 Controller and contact details
The controller of personal data is MONOKOLOR sp. z o.o., with its registered office in Bielsko-Biała, ul. Władysława Syrokomli 57, 43-346 Bielsko-Biała, Poland, entered in the National Court Register (KRS) under No. 0001259867, Tax Identification Number (NIP): 9372783279, Statistical Number (REGON): 545455307 (“MONOKOLOR”).
Contact regarding personal data: biuro@monokolor.pl or the address of MONOKOLOR’s registered office.
2 Scope of personal data processing
2.1 Use of the Website
In connection with the use of the Website, MONOKOLOR may process technical data, including in particular the IP address, information about the device and browser, the date and time of connection, URLs visited, and information about errors and technical events.
Such data is processed for the purposes of ensuring the proper and secure operation of the Website, diagnosing errors and security incidents, and establishing, pursuing or defending legal claims. The legal basis for the processing is MONOKOLOR’s legitimate interest in ensuring the security and proper functioning of the Website and protecting MONOKOLOR’s rights (Article 6(1)(f) GDPR).
Technical data and server logs are retained for the period resulting from the configuration of the server and hosting services. Access and error log archives are retained by the hosting provider for the last 30 days on a rolling basis, after which the oldest archive is automatically deleted and replaced by a new one. Where specific data is required to investigate a security incident or to establish, pursue or defend legal claims, such data may be retained for a longer period, until the relevant matter has been concluded and the applicable limitation period for claims has expired.
2.2 Contact and requests for quotations
MONOKOLOR processes data provided through the contact form or in correspondence, including in particular the user’s first and last name, email address, telephone number, company name and the content of the message, for the purposes of responding to an enquiry, conducting correspondence, preparing a quotation or taking steps prior to entering into a contract.
Where a user contacts MONOKOLOR on their own behalf for the purpose of entering into or performing a contract, the legal basis for the processing is Article 6(1)(b) GDPR.
Where the person contacting MONOKOLOR acts on behalf of or for an entrepreneur or another organisation, the legal basis for the processing is MONOKOLOR’s legitimate interest in conducting communications and maintaining business relations with that organisation and taking steps aimed at entering into or performing a contract (Article 6(1)(f) GDPR).
For other enquiries, the legal basis for the processing is MONOKOLOR’s legitimate interest in responding to enquiries addressed to it and conducting related correspondence (Article 6(1)(f) GDPR).
If the contact does not result in a contract being entered into, the data is retained for the period necessary to complete the correspondence and thereafter for a period justified by the nature of the matter and the need to protect against claims, but no longer than 12 months from the end of the correspondence, unless further retention is necessary in connection with a specific claim or dispute. If a contract is entered into, the data is retained for the period during which the contract is performed and thereafter for the period required under applicable law or until the expiry of the applicable limitation period for claims arising in connection with the contract.
2.3 Plugin X waiting list and emails
MONOKOLOR processes the user’s email address and any information voluntarily provided in the sign-up form, such as the Corona version, the 3ds Max version, experience with the Gemini API and preferred payment model, for the purposes of maintaining the waiting list and sending emails about Plugin X and related products, such as e-books, including the addition of Chaos Corona support, product updates, promotions and invitations to beta tests.
The legal basis for the processing is consent (Article 6(1)(a) GDPR), together with any consent required under applicable electronic communications laws. The data is processed until consent is withdrawn. Consent may be withdrawn at any time by using the unsubscribe link included in each email or by writing to biuro@monokolor.pl.
Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. Joining the waiting list does not constitute an application to take part in tests referred to in Section 2.4.
When the form is submitted, the IP address and browser information of the device used may be stored together with the submission for the purposes of preventing abuse and ensuring the security of the Website. The legal basis for this is MONOKOLOR’s legitimate interest (Article 6(1)(f) GDPR). This data is deleted together with the submission.
2.4 Applications to take part in Plugin X tests
Persons interested in taking part in Plugin X tests may submit an application by email to pluginx@monokolor.pl. MONOKOLOR processes the email address, information about the hardware and software configuration (in particular the 3ds Max and Chaos Corona versions and the graphics card), a general description of the types of projects, and other information contained in the application and further correspondence, such as the applicant’s name.
The data is processed for the purposes of reviewing the application, selecting testers, contacting applicants about the tests, and organising and conducting the tests. The legal basis for the processing is MONOKOLOR’s legitimate interest in organising tests and developing its software (Article 6(1)(f) GDPR). The applicant has the right to object to such processing as set out in Section 6 of this Privacy Policy.
Applications from both selected and non-selected applicants are retained until the end of the relevant tests and are then deleted within 3 months of their end. Applications from non-selected applicants are not retained for future tests; applicants may apply again for any future tests.
Applications should contain only a general description of the types of projects, without client information, confidential information or API keys. An application to take part in tests does not constitute joining the waiting list or consent to receive marketing communications.
2.5 Purchase, licence and support for Plugin X
Polar Software, Inc. is the authorised reseller and merchant of record for Plugin X. With respect to checkout, payments, taxes, transaction documents, refunds, chargebacks and other activities related to entering into and servicing the sales contract between Polar and the purchaser, Polar acts as a separate controller of personal data in accordance with its own privacy policy. MONOKOLOR does not receive full payment card details.
To the extent that Polar processes users’ personal data for the purpose of providing services to MONOKOLOR, in particular services related to the activation and management of Plugin X licences, Polar acts as a processor on behalf of MONOKOLOR in accordance with Polar’s Data Processing Addendum.
In connection with the purchase, activation and servicing of Plugin X, MONOKOLOR may receive from Polar data necessary to provide the Product, manage the licence and provide support, including in particular the purchaser’s contact details, company name, country, transaction identifier and transaction date, the Product purchased, order or refund status, as well as licence and activation data, including the name of the Device indicated as the label for the relevant activation.
MONOKOLOR may also process data voluntarily provided by the user in connection with a technical support request, including in particular contact details, information about the version of the Application and system configuration, a description of the issue, error messages, and screenshots or other materials provided by the user and necessary to handle the support request.
The data is processed:
- a) for the purposes of performing the EULA, providing and managing the licence, providing updates and support – on the basis of Article 6(1)(b) GDPR, where the user is a party to the contract;
- b) in the case of data relating to persons acting on behalf of or for an entrepreneur – on the basis of MONOKOLOR’s legitimate interest in performing the contract with the organisation represented by such person and conducting related communications (Article 6(1)(f) GDPR);
- c) for the purposes of preventing abuse, protecting MONOKOLOR’s rights, and establishing, pursuing or defending legal claims – on the basis of MONOKOLOR’s legitimate interest (Article 6(1)(f) GDPR);
- d) to the extent necessary to comply with legal obligations incumbent on MONOKOLOR, including in particular tax and accounting obligations and obligations relating to the handling of complaints, where applicable – on the basis of Article 6(1)(c) GDPR.
Data necessary to verify licence entitlements and manage the licence may be retained for the duration of the licence. Data relating to technical support is retained for the period necessary to handle the relevant support request and thereafter, where justified, until the expiry of the applicable limitation period for claims. Data that must be retained pursuant to applicable law is retained for the period required under such law.
2.6 Website analytics
After obtaining the required consent, MONOKOLOR may use Google Analytics 4, implemented through MonsterInsights, for the purposes of measuring Website traffic, analysing how the Website is used and improving the Website. The legal basis for the processing is the user’s consent (Article 6(1)(a) GDPR).
User-level and event-level data processed in Google Analytics 4 is retained for 14 months. This period is independent of the lifetime of the individual cookies used by Google Analytics.
Detailed information regarding the cookies and similar technologies used, their duration and the methods for giving, withdrawing or changing consent is provided in Section 9 of this Privacy Policy.
2.7 Legal obligations and claims
Personal data may also be processed for the purposes of complying with legal obligations (Article 6(1)(c) GDPR) and establishing, pursuing or defending legal claims (Article 6(1)(f) GDPR). In such cases, the data is retained for the period required under applicable law or until the expiry of the applicable limitation period for claims.
3 Source of personal data and voluntary provision of data
Personal data is obtained directly from the user, from the user’s activity on the Website or, in the case of the purchase of Plugin X, from Polar. Personal data relating to contact persons or representatives of entrepreneurs may also be obtained from the organisation represented by such persons or from publicly available professional or official register sources.
The provision of personal data is voluntary, but it may be necessary in order to receive a response, obtain a quotation, join the waiting list, apply to take part in tests, perform the EULA, receive Plugin X or obtain support. Failure to provide the required data may make it impossible to carry out the relevant activity.
4 Recipients of personal data and transfers outside the EEA
Personal data may be disclosed or entrusted for processing, to the extent necessary for the relevant purposes, in particular to:
- providers of hosting, Website maintenance, email services, backups, cybersecurity and communication tools;
- providers of forms and anti-spam services, including Automattic Inc. in connection with the use of Akismet;
- Google Ireland Limited and Google LLC in connection with the Website’s use of Google Analytics and other Google services and resources, to the extent resulting from the configuration of the Website and the consents given by the user;
- Polar Software, Inc. – as a processor acting on behalf of MONOKOLOR with respect to services related in particular to the activation and management of Plugin X licences, and as a separate controller to the extent that Polar independently conducts the sale to the purchaser as merchant of record, including the handling of checkout, payments, taxes, transaction documents, refunds and chargebacks;
- providers of legal, accounting and technical services and other entities supporting MONOKOLOR in conducting its business;
- public authorities and other entities authorised to receive personal data under applicable law.
Some service providers processing personal data on behalf of MONOKOLOR may have their registered offices outside the European Economic Area or may process personal data outside the European Economic Area, in particular in the United States. In such cases, MONOKOLOR ensures that an appropriate transfer mechanism required under the GDPR is used, in particular an adequacy decision issued by the European Commission or appropriate safeguards such as Standard Contractual Clauses adopted by the European Commission.
Where personal data processed by Polar on behalf of MONOKOLOR is transferred outside the EEA, the transfer is carried out in accordance with Polar’s Data Processing Addendum, which provides for the application of the European Commission’s Standard Contractual Clauses for controller-to-processor transfers. To the extent that Polar acts as a separate controller of personal data, the rules governing any international transfers are set out in Polar’s privacy policy.
Information regarding the transfer mechanism used by MONOKOLOR and, where applicable, how to obtain a copy of the relevant safeguards may be obtained by contacting MONOKOLOR using the contact details specified in Section 1 of this Privacy Policy.
The above information concerns transfers of personal data by MONOKOLOR or by entities acting on its behalf. The flow of Input Data and Results between the user’s Device and the Google Gemini API using the user’s own API key is described separately in Section 5 of this Privacy Policy and does not take place through MONOKOLOR’s infrastructure.
5 Plugin X and the Gemini API
Plugin X uses the user’s own Google Gemini API key. Input Data, including the render and prompt, is transmitted by Plugin X directly from the user’s Device to Google’s infrastructure via the Google Gemini API, and the Result is transmitted directly from Google’s infrastructure to the user’s Device.
MONOKOLOR’s infrastructure does not participate in this automated data flow, and MONOKOLOR does not receive, store or otherwise obtain access to the Input Data, Results or the user’s Google Gemini API key. The API key is stored exclusively locally on the user’s Device.
Plugin X does not transmit to MONOKOLOR usage logs or telemetry concerning the manner in which the Application is used. However, in connection with licence activation and management, data necessary to manage the licence and enforce its parameters may be transmitted to Polar, including the Device name provided as the label for the relevant activation. MONOKOLOR may access such data through Polar to the extent necessary to manage the licence and provide support.
The above does not exclude situations in which the user voluntarily provides MONOKOLOR with specific information or materials in connection with a technical support request.
Data transmitted to the Google Gemini API is processed by Google in accordance with the Google Gemini API terms of service and the privacy and data processing terms applicable to the service used by the user. In this data flow, the user uses their own Google account and Google Gemini API key, and MONOKOLOR neither determines the scope of the Input Data transmitted by the user to Google nor obtains access to such data.
6 User rights
Subject to the conditions set out in the GDPR, the user has the right to request access to their personal data, rectification or erasure of such data, restriction of processing, and – in cases provided for by law – the right to data portability.
Where processing is based on MONOKOLOR’s legitimate interest referred to in Article 6(1)(f) GDPR, the user may object to such processing on grounds relating to their particular situation.
Where personal data is processed on the basis of consent, the user may withdraw their consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
Requests relating to the exercise of the above rights may be submitted to biuro@monokolor.pl or to the address of MONOKOLOR’s registered office specified in Section 1 of this Privacy Policy.
The user also has the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych) if the user considers that the processing of their personal data infringes applicable data protection laws. Information regarding the lodging of complaints is available at https://uodo.gov.pl/. The user may also lodge a complaint with the supervisory authority in the EU Member State of their habitual residence, place of work or place of the alleged infringement.
Where a request concerns personal data processed by Polar Software, Inc. as a separate controller, the user should address the request directly to Polar.
7 Automated decision-making
MONOKOLOR does not make decisions concerning users based solely on automated processing that produce legal effects concerning them or similarly significantly affect them.
